Annual Minutes 2009
I.
Welcome and Call to
Order:
Ken Hall called the meeting to order at 6 pm.
II.
Appointment of
Election Inspectors:
The elected
delegates listed below were present to count ballots. Nelda Mitaly, CFO,
Carol Schecter CEO, Joyce Winward, Director of Community Management and
Susan Teaff COO, from Benchmark Association Services were on hand to
oversee the counting and tabulation.
III.
Homeowners Forum—Comments
are to be limited to three minutes per person.
a.
Bicyclists taking over the Lakes loop, not obeyi8ng the
traffic laws and being confrontational when questioned. The fact is that
cyclists have to obey the rules of the road. Police have been notified
and bikers cited. Their parking and riding two and three abreast in
packs is a nuisance and a road hazard. If the public sees them breaking
the rules of the road they should call 311, metro has to be informed.
Call your councilman’s office as well. The more of response the public
has the more attention the problem will get.
b.
Desert Landscaping: where is it in the CC&Rs? Answer: it
is not in the CC&Rs. This is a city code and water authority parameter.
The Arc Committee is using the Water Authority standards for conversion
to xeriscape. In other words, there must be at least 30% of the property
planted if grass is removed: that is the major prerequisite.
c.
Neighborhood Watch Signs: who pays for them, do they
cost? Answer, yes they do cost money and the WSCA should foot the bill.
It will be placed on the July agenda.
d.
Violations: homeowners wanted to know if they can find
out what is happening when they report violations. Manager pointed out
that the violations and fines imposed on other accounts is a private
matter between the Association and the member: information can not be
divulged. The manager can only say if the matter is closed or still
open.
e.
Foreclosed properties: owners, fines, what can be done?
Foreclosed properties are a problem: banks sometimes turn off utilities
and let the properties go. There is new legislation that will aid in
leveraging banks to take care of the properties, they will also have to
pay 9

months
assessments in arrears and the Board will be able to intervene on a
property to clean it up and bill the owner. It is a problem that is not
going away in a big hurry. The board is doing everything it can as far
as fines and letters etc.
f.
Homeowner asked about xeriscape for the common area, what
is the future? Board has cut back on xeriscape plans for financial
reasons. The Board will allow some grass to remain. Also, the rebates
may be curtailed by the water authority.
g.
What are the inspection parameters? The inspector goes
out twice a month to inspect for violations. The first is the entire
community. The second is a recheck for all properties called to hearing.
The Manager also does a common area inspection once a month.
h.
Homeowner stood up to unabashedly state that WSCA is the
best place to live in the city: low crime, beautiful landscape, low
assessments, convenience.
IV.
State of the
Association Report—By
the Board President
Ken Hall
introduced the Community Manager, Christian Diamandis.
He thanked
Captain’s Cove for their hospitality, good food and atmosphere.
He thanked
the board for all their hard work: June Brooks, Anthony Ruggiero, Sharon
Silva.
He thanked
Donna Toussaint for her help and advice on many important matters and
her maintaining the web site.
The
Chairman addressed assessments: the fact that the Board is trying to
hold the line. He noted the economic downturn has hit everyone, that is
one reason the Board cut back on xeriscaping, and some other
expenditures. The Association is still solvent and healthy in spite of
the tough economy. Ken Hall spoke of the constant battle against
graffiti and asked that the community report any such activity: it is a
very expensive destructive crime.
He
addressed changes to NRS that will affect the community: the legal
advisor to the community is coming to the next meeting to elaborate on
the delegate issue - they may be obsolete - three year terms of office
for the Board members per the documents – Wall ownership and
responsibility etc.
National
Night Out will be set in West Sahara: a flyer announcing the event is
forthcoming. Ken Hall urged the community to come, to participate and to
get in touch with Councilman Wolfson’s office for more information.
Anthony Ruggiero spoke to the Board’s fiduciary duties: he stated the

Board has been a good steward for the community funds.

Diamandis, community Manager, read from the financial reports:
Assets: Operating $413,352
Reserves $ 470,581
Accounts
Receivable Assessments $273,457
This is high, but, the outlook for collecting most of it is good.
Monthly
expenses run about $78,000
Quarterly
assessments are $239,000.The budget is pretty close.

Approval of the Annual Meeting Minutes
A.
June 30, 2008 : The annual meeting minutes for
2008 were unanimously approved.

Announcement of
Voting Results:
See Page 4
for results. Anthony ruggiero won the election and William D. Ely placed
second, both were confirmed elected to the Board of Directors for West
Sahara Community Association.
VII.

Silva nominated Ken Hall to continue as Chairman, June Brooks Seconded
the motion: motion carried unanimously.

motion, the motion carried unanimously.

Ruggiero nominated Sharon Silva to be the Secretary/ Treasurer, William
Ely seconded the motion: the motion carried unanimously.

Organizational Items

Execute New Board Member Paperwork and Bank Signature
Card: Signature card tabled until the next
meeting. Ombudsman forms were all filled out and handed back to the
manager.

Discuss Board/Management Liaison:
Ken Hall is still to be the liaison to the Board: all
Board decisions outside of meeting will go through him.

Discuss Meeting Schedule:
Meeting schedule remains the same, fourth Tuesday every month at 4 pm
for executive session, 5 pm regular.
IV.
Adjournment:
